Collection of evidence by smart systems (especially in motor vehicles)
Alongside the political calls for more electromobility, the driving of motor vehicles supported by autonomous systems is increasingly moving into the focus of public perception. The corresponding legal questions of who bears substantive responsibility when and to what extent are already being discussed in practice as well as in the literature. However, what has remained largely unaddressed so far is the question of what possibilities and limitations exist for criminal procedural law with regard to the collection and utilization of evidence in connection with computer-aided driving. The research core theme thus is dedicated to an analysis of the gathering, collection and utilization of evidence de lege lata and de lege ferenda, as well as a detailed discussion of the limits set by the rule of law. This includes a discussion of the extent to which an A.I.-assisted automated forwarding of evidence-relevant material to law enforcement authorities can have its place in a state governed by the rule of law.
